These terms and conditions (together with the documents referred to in them) set out the legally binding contract on which The Gawthorpe Maypole Committee permits your reservation of a place and participation in the World Coal Carrying Championships.
- ENTRY
- Submission of the online entry form does not guarantee you a place in the Event. Receipt of your entry constitutes an offer by you to reserve a place and participate in the Event on these terms and conditions and in accordance with the rules of the race (Race Rules).
- During the entry process, you will be invited to make payment of an entry fee. Subject to clauses 1.3and 3.1, entry fees are non-refundable.
- Upon receipt of your entry and entry fee, the Committee will confirm your place by email. Places remain provisional until confirmed by the Committee by email. If the Committee is unable to confirm your place, your entry fee will be refunded.
- All places are non-transferable without the prior written consent of the Committee.
- EVENT
- In participating in the Event you agree to:
- Comply with Race Rules and all reasonable instructions of the Committee and its representatives at all times;
- Register on the day at The Boot and Shoe, 27 High Street, Gawthorpe, WF5 9QS, where you will receive your t-shirt, number and further instructions;
- Act responsibly and avoid causing annoyance, disturbance, or nuisance to competitors, spectators, or the public.
- Acknowledge that the Event is physically challenging and carries inherent risks, including personal injury;
- Confirm that you participate entirely at your own risk, are medically fit, and will inform the Committee of any condition which may affect your participation;
- Consent to first aid or emergency medical treatment if needed;
- Report any accident or incident immediately to the Committee or its representatives;
- Not be under the influence of alcohol or non-prescription drugs;
- Be bound by The 2021 UK Anti-Doping Rules and submit to the authority of United Kingdom Anti-Doping Limited in their application and enforcement;
- Confirm that you are not currently banned from competing in any sport; and
- Accept responsibility for your own belongings. The Committee will not be liable or responsible for any losses or damage;
- In the absence of any negligence or other breach of duty by the Committee, participation in Event is entirely at your risk.
- In participating in the Event you agree to:
- CANCELLATION AND DISQUALIFICATION
- The Committee may make changes to, or cancel, the Event at any time, including where it believes the conditions unsuitable (such as adverse weather), there to be unmanageable risks or because of events, circumstances or causes beyond its reasonable control. In such cases your entry fee will be refunded unless the Committee offers you the option to transfer your place to the following year which you accept.
- The Committee will not be liable or responsible for any failure to perform, or delay in performance of, any of the Committee’s obligations under these terms and conditions that is caused by unsuitable conditions, unmanageable risks or because of events, circumstances or causes beyond its reasonable control.
- The Committee reserves the right to cancel your place or disqualify you where you are, or are later found to be, in breach of these terms and conditions or the Race Rules.
- In the event that you are disqualified after having received any prize money and/or trophy, you will immediately return the full amount of such prize money and the trophy to the Committee upon notification of disqualification. The Committee may take any necessary steps to recover the prize money and/or trophy if they are not returned in accordance with this clause 3.4.
- If you wish to cancel your place for any reason, including due to injury or a medical condition, please email coalrace@gawthorpemaypole.org.
- MISCELLANEOUS
- Failure by the Committee to exercise any right will not constitute a waiver of that right.
- If any provision is invalid or unenforceable, it will be modified or removed to the minimum extent necessary without affecting the remainder of these terms and conditions.
- Notices to the Committee should be sent by email to coalrace@gawthorpemaypole.org and will be deemed received upon transmission (or when working hours resume if sent outside normal hours).
- No third party will have rights under the Contracts (Rights of Third Parties) Act 1999.
- These terms and conditions and any related disputes will be governed by the laws of England and Wales, with exclusive jurisdiction vested in the courts of England and Wales.
